Consent to Operate

 

 


As per provisions of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981, all running units and the units before starting operation (Industries, Mines, Urban Local Bodies and Health care Units as applicable) have to apply for consent to operate. Consent to Operate can be obtained by applying to Board with adequate fees and requisite documents and information through online services. The Board, considering compliance of environmental laws by the unit issues consent to operate to it. Consent to Operate is to be renewed periodically and renewal application is to be submitted 120 days prior to the expiry of previous order.

Depending upon the pollution and hazard potential of industrial activities, the industries are categorised as Red, Orange, Green and White. The industrial projects are further classified into Category A, Category B and Category C as follows

The Board has delegated powers to officers at Head Office as well as Regional officers in the matter of grant of consent to operate as follows:

Regional Office Regional Officer
  • Other than 17 Category of polluting industries (Red-A) i.e., Red-B, Orange and Green having investment of Rs. 50 crore or more
  • Mines other than Coal, Bauxite, Iron Ore, Manganese, Limestone, Dolomite & Chromite.
